InsuranceP&CDistribution & Customer Onboarding

Disclosure & Consent Agent

Produces channel-, product-, and jurisdiction-specific customer disclosures and consent records.

Notices are not interchangeable and not optional. Each one is pulled at the edition in force in that state on that date, delivered by a method the state accepts, and evidenced. Where a rejection has to be affirmative, silence is recorded as silence. Terrorism, surplus lines and producer compensation disclosures carry a producer or compliance review before the file moves.

Illustrative workflow

How the work moves

Starting point

A commercial package binder incepts in a state requiring a terrorism rejection notice, with the excess layer sitting on non-admitted paper.

  1. 01

Resolve the filed forms, the current edition of each required notice, and which coverage parts sit on admitted and which on non-admitted paper.

  2. 02

Assemble the terrorism disclosure showing the premium attributable to that coverage and the federal share, alongside the surplus lines notice that a non-admitted insurer sits outside the state guaranty fund.

  3. 03

Capture the insured's written terrorism rejection and run readability and completeness validation over the pack.

  4. 04

Flag the producer compensation disclosure, because the retail broker is acting for the insured on this placement.

Result

Versioned disclosure packet with the terrorism rejection captured in writing and the compensation disclosure held for the producer of record.

Checks and boundaries

What must be tested or reviewed

  1. 01Completeness tests require the correct form edition, a delivery method the state accepts, and the acknowledgement the state requires, for each jurisdiction, coverage part and paper type on the program.
  2. 02A rejection that has to be affirmative is scored only on a captured written rejection; treating silence, a blank field or an abandoned session as agreement is a failure.
  3. 03Substituting a form, editing approved language, or reusing a superseded edition fails the run, and the diff naming the substitution is part of the output.

Human authority

  • The licensed producer of record delivers any disclosure that carries a recommendation or a rejection of coverage, because the signature the state expects on it is a licensed one.
  • The compliance officer approves any departure from approved language or from the standard delivery method, because a substituted form is a form violation even where its content reads better.
